In accordance with the applicable regulations on the protection of personal data, Fundación Anunciata Solidaria informs you that the personal data collected through the forms on the website http://www.anunciatasolidaria.org is stored in a specific automated file of website users called “Website Users”. This file contains the messages, names, and email addresses submitted to contacto@anunciatasolidaria.org through the website’s contact forms.
These contact forms are available in the following sections: Study Scholarships, Sponsors, FASOL Friends, Solidarity Legacy, Volunteering, and Contact.

The collection and automated processing of this personal data is intended to maintain our relationship with our supporters and collaborators, as well as to carry out information, training, advisory, volunteering, and other activities related to the mission of Fundación Anunciata Solidaria.

  1. To respond to enquiries about the Foundation’s activities, objectives, and mission, as well as the different ways to support and collaborate with us.
  2. To maintain an open channel of communication with our current and prospective supporters and collaborators.

The fields in these forms are mandatory. Without providing your name, email address, and message, it will not be possible to fulfil the purposes described above.

How long will the personal data collected be retained?

The personal data you provide will be retained for as long as your relationship with Fundación Anunciata Solidaria continues, or until you request its deletion, and thereafter for the period during which legal liabilities may arise in connection with the services provided.

Recipients of Personal Data

Data Collected by Users of the Services

Where a user uploads files containing personal data to shared hosting servers, Fundación Anunciata Solidaria shall not be held responsible for the user’s failure to comply with the requirements of the General Data Protection Regulation (GDPR).

Data Retention in Compliance with the Information Society Services Act (LSSI)

Fundación Anunciata Solidaria informs users that, as a provider of data hosting services and in accordance with the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), it retains, for a maximum period of 12 months, the information necessary to identify the origin of the hosted data and the date on which the provision of the service began.
The retention of this information does not affect the confidentiality of communications and may only be used in the context of a criminal investigation or to safeguard public security. Such information will be made available to the competent courts and tribunals or to the relevant public authority upon lawful request.

Any disclosure of personal data to the State Security Forces and Bodies shall be carried out in accordance with the applicable personal data protection legislation.

Intellectual Property Rights

Fundación Anunciata Solidaria is the owner of all copyrights, intellectual and industrial property rights, know-how, and any other rights relating to the content of the website http://www.anunciatasolidaria.org, the services offered through it, the software required for its operation, and all related information.

The reproduction, publication, or any use of the contents of http://www.anunciatasolidaria.org, whether in whole or in part, other than for strictly private purposes, is prohibited without the prior written consent of Fundación Anunciata Solidaria.

Software Intellectual Property

The user must respect the intellectual property rights of any third-party software made available by Fundación Anunciata Solidaria, even where such software is provided free of charge and/or is publicly available.

Fundación Anunciata Solidaria holds the necessary intellectual property rights and rights of use for the software made available through this website.

The user does not acquire any rights or licence, by virtue of the services provided, in relation to the software required for the provision of those services or the technical information associated with their operation, except for the rights and licences strictly necessary for the use of the services provided, and only for the duration of those services.

For any action that goes beyond the performance of the contract, the user must obtain the prior written authorisation of Fundación Anunciata Solidaria. The user is prohibited from accessing, modifying, or viewing the configuration, structure, or files of servers owned by Fundación Anunciata Solidaria. The user shall be held civilly and criminally liable for any incident affecting the servers or security systems that results directly from any negligent or malicious act on their part.

Intellectual Property Rights in Hosted Content

The use of the services provided by Fundación Anunciata Solidaria in any manner that infringes intellectual property laws is strictly prohibited. In particular, the following are prohibited:

  • Any use that is contrary to Spanish law or that infringes the rights of third parties.
  • The publication or transmission of any content that, in the opinion of Fundación Anunciata Solidaria, is violent, obscene, abusive, unlawful, racist, xenophobic, or defamatory.
  • Software cracks, serial numbers, licence keys, or any other content that infringes the intellectual property rights of third parties.
  • The collection and/or use of other users’ personal data without their explicit consent, or in breach of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).
  • The use of the domain’s mail server or email addresses to send unsolicited bulk email (spam).

The user is solely responsible for the content of their website, the information transmitted and stored, any hyperlinks, any claims made by third parties, and any legal actions relating to intellectual property, the rights of third parties, and the protection of minors.

The user is responsible for complying with all applicable laws and regulations, as well as the rules governing the operation of online services, electronic commerce, copyright, the maintenance of public order, and the generally accepted principles governing the use of the Internet.

The user shall indemnify Fundación Anunciata Solidaria for any costs arising from the investigation or prosecution of cybercrime or other computer-related offences where responsibility is attributable to the user. This includes legal fees and defence costs, even where the relevant judicial decision is not yet final.

Protection of Hosted Information

Fundación Anunciata Solidaria performs backup copies of the content hosted on its servers. However, it shall not be held responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the full recovery of data deleted by users, as such data may have been deleted and/or modified during the period of time elapsed since the last backup was made.

The services provided, with the exception of dedicated backup services, do not include the restoration of content stored in backup copies made by Fundación Anunciata Solidaria where the loss of such content is attributable to the user. In such cases, a fee will be determined according to the complexity and scope of the recovery process, subject to the user’s prior acceptance.

The restoration of deleted data is included in the service fee only where the loss of content is due to technical issues attributable to Fundación Anunciata Solidaria and not to any malicious use or actions involving the data by the user.

Commercial Communications

In accordance with the Information Society Services and Electronic Commerce Act (LSSI), Fundación Anunciata Solidaria will not send advertising or promotional communications by email or any other equivalent electronic means unless they have been previously requested or expressly authorised by their recipients.

Where there is a pre-existing contractual relationship with the user, Fundación Anunciata Solidaria may send commercial communications relating to information, services, or campaigns of Fundación Anunciata Solidaria that are similar to those originally requested or contracted by the user.

In all cases, the user may, after verifying their identity, request that no further information be sent to them through the available contact channels.
